The EU recognizes Kosovo and this will lend a hand to Catalonia, Lombardy and Veneto ? fantasies referendum
Economic relations with the EU should not be confused with recognition of a state.
E’ true that the EU presses on Belgrade for special autonomy for Kosovo, and for the respect of rights of national minorities, but this should not be confused with recognition of independence of a state.
The EU has precise obligations in the treaties for the membership of a state to the Union, and be aware that those covenants imposed on new members who need access to the EU, but not as vigorously to members such as Italy who are already part of it.
For example, Italy would never be admitted if it were out due to public debt, and for violation of minorities.
In short, it is necessary to distinguish between what the EU does outside the EU and what it does inside the EU.
For certain until a few weeks ago, Serbia fully proved not to recognize Kosovo as an independent (see articles below) so it is clear that not even the EU has demanded it (otherwise it would be the violation of agreements with the EU!)
So I understand that at the present time that the EU recognizes Kosovo as a state.
Now the referendum have troubles to rejoice in the fact that the EU recognizes a special autonomy, perhaps even a “status”.
In Italy they have taken pains to say that Article 5 of the Constitution is no longer valid.
In fact, Article 5 has never applied when it comes to the self-determination of a people, because the right to self-determination prevails as international law. This is known by the referendum of the Veneto as I explained to him since 1999. But the Veneto people say it because they know that there is a Venetian people and it is also legally recognized by Italy.
But in Veneto they confused the “people Venetian” with the “Veneto region”.
The independence of an administrative region has nothing to do with the international independence of a people, I have already explained this many times.
Every nation is defined by its national character, as a language, history etc..
If it is declared invalid the regional border imposed by the Italian government, and it does not recognize the international ones of a people, then, just as the legal confinement is valid for the region, the constitutional one is also valid, i.e. the article 5 preventing the secession.
Otherwise independence must be pursued on the basis of the ethnic concept of the people, and then the unit imposed by Article 5 does not apply, nor the internal borders of that order.
Looking ethnically, it is impossible to maintain that Lombardy is inhabited by a single people, because large territories speak Venetian or a Venetian variant and have always been with Venetia in the past 2500, just as it is impossible to maintain that those who speak Veneto in Friuli Venezia Giulia are not Venetians.
This is true in the international sense and then in the International Court of Justice.
Tornado on Kosovo's speech (external to the EU) and any influences on domestic situations to the EU,the EU has already said it will not recognize independent Catalonia. This is also imposed by the Treaty of Lisbon which obliges the EU to respect the territorial integrity of the states. In other words, if the EU would make it responsible for the infringement of the Treaty, Spain could sue her and make her pay for the damage. This despite both ethnically autonomous Catalonia, bilingual with a minority language, and is both independent. But the human and linguistic rights seem widely respected as in South Tyrol , For example.
In other words the case of Catalonia , that is inside the EU, it is completely different from that of Kosovo.
Worse of Catalonia have the case of Lombardy, Veneto etc., all of which are penalized by being in EU (because the EU is bound to keep Italy united) but they are further penalized by not having a minority language recognized, nor special autonomy.
These situations are not even remotely comparable with the situation of Kosovo which is not in the EU and has US backing (but also the opposition of Russia and China)
Confusing the situation with those intra-EU Extra-EU only demonstrates the lack of knowledge of the Lisbon Treaty.
What we learn from this ? Nothing new, just another confirmation of misinformation referendum.
