A Comissão Européia deve enfrentar a Itália perdendo território e o PNB
In these days the European Commission is facing an hard juridical problem concerning its own territoriality. The EU Commission was asked to investigate on the fundamental right violations against the Venetian minority made by the Italian state.
The representative group of the Venetian minority in the Italian institutions, the political party “Venetie para autogoverno” asked the Commission to apply subsidiarity and oblige the Italian state to stop violations against the human rights of the Venetian national minority after that 9 Italian courts had been asked to do the same with 2 local and central autorities. They were asked to apply the current Italian and European law recognizing political and linguistic rights for the Venetian People national minority but the Italian judges simply denied without investigating or simply they didn’t answer main questions. In Italy there was no way to have an answer against the “Rule of Law” basic principle: they make laws but they do not apply them.
The European Commission in a first answer simply replly that the Italian law does not recognize the Venetian minority (even if it is clearly stated by the Italian law n.340 of 1971 at article 2) and this is not an European attribution , but the problem seems to be more difficult to solve. In fact in the end of 2010 the Italian Parliament abolished thousands of “old” laws (“taglialeggi” law), including the law of annexation of the “Kingdom of Lombardy and Venetia” made in 1866. The EU Commission has to face the problem that Lombardy and Venetian territory (30% of Italian PNB – 10% of UE economy) is legally an independent one from an international point of view, and for that reason the EU Commission would have to initiate an international relationship with this sovereign territory.
The representatives of the Venetian People minority remembered the EU Commission that the EU holds the responsibility in front of the Council of Europe and the Internation Court for any violation of International Law, as stated in the Lisbon treaty, and that they are responsible from now on for any violation or economic stroke that the venetian people will face because of their inactivity against the Italian state. At the moment the party simply asks for the application of the “Framework Convention for the Protection of National Minorities” that Italian government does not guarantee despite it is law in Italy since far 1998.
